Debt Restrictions In Bankruptcy : Finance

Both Chapter 7 and Chapter 13 bankruptcy have acceptability specifications which can stop individuals from being able to file under that specific chapter. The most well known being the mean-test need under Chapter 7. Basically if an individual earns above a specific amount, that person won't be fit for Chapter 7 protection, and may only be eligible to file for Chapter 13. Unlike Chapter 7 , however , Chapter 13 has debt restrictions which have increasingly caused more folk to not have eligibility to file.

Section 109(e) of the Bankruptcy code places constraints on the amount of debt that an individual might have so as to file for Chapter 13. So as to be accepted to file for Chapter 13, an individual must have less than $360,475 of unsecured debt, and must have less than $1,081,400 of secured debt. Since these numbers on first look seem exceedingly high, plenty of our clients are typically shocked when they discover that they will not be admissible because they surpass those debt limits.

The reason why more of our customers are having issues with surpassing the debt limitations of 109(e) is thanks to the shortage of equity in their houses. The collapse of the housing market hit SW Florida as hard as anywhere else in the USA. A direct effect of the housing market collapse is that many people in SW. Florida now owe more on their home than it is worth. The amount that a homeowner is underwater on their home counts toward the $360,475 unsecured debt limit. Also , if a homeowner is underwater on their first loan and they have also got a 2nd mortgage, that complete second mortgage would be considered unsecured. Since so many house owners are underwater on their houses, many of them are discovering that they would surpass the unsecured debt limit regardless of if their other debt is low.

Fresh Florida cases have eased these limitations somewhat , at least for married debtors who file jointly. In In Re Scholz and In Re Hannon the bankruptcy court held that married people can stack their debt limits while each spouse would be in a position to file their own individual Chapter 13. In In Re Scholz, a married couple filed a Chapter 13 petition with $386,221.31 of unsecured debt and the Chapter 13 Trustee moved to dismiss the argument for surpassing the unsecured debt limitation. The Judge overruled the Trustee?s objection and authorized the couple to continue with their joint Chapter 13 because as individuals, each debtor was below the $360,475 limit. It was just when their debt was mixed that they exceeded the debt limits. If married debtors are each able to file individual Chapter 13 Petitions, they may file a joint Chapter 13 petition regardless of a mixed debt total which exceeds the 109(e) limits.

See In re Scholz, no. 6:10-bk-08466-ABB (Bankr. M.D. Fla. 2011) and In re Hannon, 23 Fla. L. Weekly Fed. B132 (Bankr. S.D. Fla. 2011).

Dish Network rumored to have bought Clearwire's $400 million debt in secret transaction

Dish Network rumored to have bought Clearwire's $400 million debt in secret transactionWe're not in the habit of entering the dry world of corporate debt notes, but Sprint's latest financial release might disguise a juicy bit of news. There's a rumor in the business press that Dish Network might have bought around $400 million of Clearwire's debt -- helping relieve the pressure on Sprint, which has been keeping its subsidiary alive on handouts. Unsurprisingly, no-one's commenting on the rumors, although Dish CEO Joseph Clayton did say he was open to a partnership (or acquisition) with Sprint / Clearwire late last year. If true, it could signal that it's getting ready for a fight against AT&T -- or maybe it just wanted to throw Dan Hesse a bone.

Perplexed about philanthropy | Public Finance Opinion

The chancellor?s U-turn on limiting tax relief for charitable giving highlights Britain?s uncertain relationship with philanthropy. We understand the need for charitable donations but are uncomfortable when it comes to giving tax breaks to the well off

Now that the dust has well and truly settled following George Osborne?s 100% retreat on his so-called philanthropy tax, it is useful to reflect on what it told us. Not so much about how strange government decision making seems to be at present ? with policies brought in without thought only to be withdrawn a little later. Nor indeed how dysfunctional the Treasury is and how poor decision making is on tax in the UK.

No, what interests me more is what it seems to show we Brits think about the concept of philanthropy. Because we seem confused and perplexed.

Philanthropy is a strong word that has connotations of Victorian Britain, of the rich dispersing their largesse to look after the less fortunate, or to build municipal civic libraries or museums.? For many years we admired such people but were grateful that we no longer had to depend solely upon whether they decided to do good or not, nor what strings they might attach to it (be that religious strings or stipulations on what schools taught).

So rich people, giving away money is sort of good, and we love the fact that Bill Gates does it so much; but it is a little peculiar.

That is a problem given that as the state pulls back we are going to have to depend much more on the voluntary and charity sector, whether we call it the Big Society or not. One aspect of this will be much more reliance on volunteers keeping services going ? allowing some public services to be run on a shoestring as either charities that rely on volunteering undercut other contract bidders who do not, or where the community itself either has to run its library or community centre for free or just does not have one.

As the state withdraws, the relative importance too of the rich ? cutely and coyly known as high net worth individuals in the philanthropy and charity fundraising world ? does rise.? We need their money if we are to fund the arts and historic buildings that government has less money for but even more in areas like adult mental health, new approaches to isolation of older people, looking after and trying to solve the problems of homelessness and drug addiction ? all areas where cuts are biting hard.

So how do we persuade these well off people to put the money into charity rather than to spend it on yet another home or a new yacht??? Well, one of the answers ends up being about tax. And just as we all search for the most tax efficient place to put our (usually meagre) savings in we know the well off will be doing the same (with the help of expensive advisers) ? so it is intuitively right that we need some tax breaks to get them to give to charity not to mammon.

And then we get uncomfortable. We are giving tax breaks to very rich people to encourage them to give because the state has cut back its spending and there are more needy people as a consequence of a recession caused ? to at least some extent ? by very rich bankers.? All a little strange.

And where politicians are answerable to us for the way they spend our money, the tax-break spenders can give as they want. So if supporting an elite sports charity and one that does up old Georgian buildings or supporting Oxbridge to get ever nicer facilities takes their fancy more than looking after the poor in a forgotten northern town, then so be it.

There is no right or wrong answer to any of this. It reflects the British ambiguity to the role of the state and in our attitudes to wealth. It is also a manifestation of the tensions we feel as a nation between the desirability of local, do-it yourself, voluntaristic action to attack problems and the? horror of the unfairness of a postcode lottery in what services are available and a belief that the state must not just stand by when people are in trouble.

But while the mixed feelings will not go away, the need for philanthropic money is only going to increase. So we will get a lot more soul searching as the decade goes on.

Commentary on Politics, Religion, and Society and their ...

This has been a week of multiple stories about the emerging role of women around the world. For example, this year?s London Summer Games have been dubbed ?Olympics 2012: Year of the Woman? as for the first time in history women are represented in all participating national teams and comprise a record 45 per cent of all athletes. Enactment of Title IX in 1972 has definitely enhanced the role of U.S. women in sports and this was spectacularly on display at the London Olympics perhaps best captured yesterday as the U.S. women?s soccer team won the gold medal while the U.S. men?s soccer team did not even make it to the Olympics. Overall, U.S. women have captured double the number of gold medals as U.S. men. But contrast the U.S. women?s success to the picture in the Washington post this week of a lonely Afghan woman competing in an Olympic event for the first time despite considerable risk of punishment at home by a male dominated society where sports and most other aspects of society outside the home are restricted to men.? She and other brave Muslim women from Saudi Arabia, Qatar, and Brunei competed in the London Olympics for the first time at the prodding of the International Olympic committee.? We should all stand up and applaud these brave women, some who may well be at risk as they return home.

But the news is not all good for American women; witness the nuns (The Leadership Conference?of?Women Religious) who are huddled in?St.?Louis to decide whether they will bow to Vatican demands to toe the official line on sexual matters. In effect, the Vatican, in a recent reprimand, accused the nuns of spending too much time with the poor and not enough espousing church positions on women?s reproductive rights and homosexuality.? To enforce this, the Vatican has assigned three American Bishops to now oversee the nuns.? How sad and pathetic are these developments after the abysmal record of the Bishop?s on the pedophile cover-up. ?It would seem more appropriate to have the nuns assigned to oversee the Bishops on sexual matters.? Let?s hope the nuns do not bow down quietly on this one; they need our support.

Meanwhile, the City of Houston recently reported the opening of Freedom Place, the state?s first privately run safe house that provides long-term housing for American girls who are victims of sex trafficking, a practice rampant here and around much of the world.? And right here in the nation?s capital at our own N Street Village?s Promise Place, we saw a record number of homeless women come through our doors this year, many who have suffered from sexual and other abuses.

And finally, it?s ironic that for many of our male Presidential aspirants this year, women?s reproductive rights were often their lead issue while so many Americans are suffering through a weak economy.? Similarly, among male dominated state legislatures, we have seen increasing attempts this year to repress women?s reproductive rights with such measures as Personhood amendments, vaginal ultrasound requirements, and elimination of Planned Parenthood funding.? So with some irony, we may truly declare this the ?Year of the Woman?.?

On a more serious note, we need to ask why women?s rights are still such an issue here at home as well as around the world.? One answer is that fundamentalist elements of all three monotheistic religions tend to subjugate women. This often comes from a literal reading of the scriptures, which leaves cultural customs stuck in the same place they were two thousand or more years ago. For example, Paul's writings (e.g., 1 Corinthians 11:2?10) implying subservience of women is particularly problematic in Christian communities. But progressive churches, including my own Lutheran tradition, have come to a position of full inclusion of women through study and reflection of the scriptures as a whole and interpretation for our times. In regard to the equal role of women, progressive churches typically cite the following aspects of scripture, among others:

????????? Old Testament prophets call for justice, speak out against inequities, and stand with the oppressed.

????????? Jesus had women as friends, disciples, and witnesses; he challenged the conventional beliefs of his day that women were inferior and men were superior.

????????? The Apostle Paul called the people of God to create a world where the gifts of both women and men are celebrated and used, where ?there is neither male nor female, but all are one in Christ Jesus? (Galatians 3:28).

So yes we can celebrate the many recent gains for women in our society while recognizing that there is still a long way to go.

US runner finishes Olympic relay lap on broken leg

United States' Manteo Mitchell competes in a 4x400-meter relay heat during the athletics in the Olympic Stadium at the 2012 Summer Olympics, London, Thursday, Aug. 9, 2012. Manteo had half a lap to go in the first leg of the 4x400-meter relay preliminaries Thursday and a choice to make: keep running or stop and lose the race. To him, it was never much of a choice. He finished the lap and limped to the side to watch the Americans finish the race and qualify easily for the final. A few hours later, doctors confirmed what he suspected: He had run the last 200 meters with a broken left fibula. (AP Photo/Anja Niedringhaus)

(AP) ? Manteo Mitchell heard the POP! and knew it wasn't good. "It felt like somebody literally just snapped my leg in half," he said.

The American sprinter had 200 meters to go in the first leg of the 4x400-meter relay preliminaries Thursday and a decision to make: keep running or stop and lose the race. To him, it was never much of a choice.

He finished the lap and limped to the side to watch the Americans finish the race and qualify easily for the final. A few hours later, doctors confirmed what he suspected: He had run the last half-lap with a broken left fibula.

"I heard it and I felt it," Mitchell told The Associated Press. "But I figured it's what almost any person would've done in that situation."

Mitchell finished his heat in a more-than-respectable 46.1 seconds, and the United States tied the Bahamas in the second heat in 2 minutes, 58.87 seconds ? the fastest time ever run in the first round of the relay at the Olympics.

The 25-year-old sprinter from Cullowhee, N.C., said he was diagnosed with a complete break of the left fibula ? but it was not a compound fracture and the bone is expected to heal on its own in four to six weeks.

He knew what the stakes were when he lined up to run the first leg of his first Olympics. The Americans have won gold in the last eight long relays they've entered at the Olympics.

"Even though track is an individual sport, you've got three guys depending on you, the whole world watching you," Mitchell said. "You don't want to let anyone down."

He said he slipped on the stairs a few days ago in the athletes village but didn't think much of it. Training went well and he felt good when he lined up to kick things off for the Americans. He said he was feeling great, as well, when he looked at the clock while approaching the 200-meter mark, somewhere in the high-20 or low-21-second range.

"I was doing my job," Mitchell said. "But probably at 201 meters, I heard it and I felt it."

He credited something more than simple adrenaline for pushing him the rest of the way around the track.

"Faith, focus, finish. Faith, focus, finish. That's the only thing I could say to myself," he said.

Mitchell was a promising high school football player at Crest High School in Shelby, N.C., when another broken bone altered his career. He broke his left arm, and his coaches ? seeing the natural talent ? pushed him over to the track.

Western Carolina coach Danny Williamson saw Mitchell finish second several times to a future Olympian, Travis Padgett, and offered a scholarship.

"He was a team person here," said Williamson, who received the first call from Mitchell after he got off the track Thursday. "As soon as he came to Western Carolina, no matter what the situation, he'd do anything we asked of him."

On the world's biggest stage, Mitchell took the team-first thing to a whole new level.

He is the 2012 version of Jack Youngblood, the Rams linebacker who played the Super Bowl on a broken leg. Or Tiger Woods, who won the 2008 U.S. Open on a broken leg. Or, maybe most appropriately, Kerri Strug, whose vault on a sprained ankle sealed the first-ever Olympic team gymnastics gold for U.S. women at the 1996 Atlanta Games.

"I don't know how you write this, but I'd like to believe the only way he would have stopped is if the leg had fallen off," Williamson said.

Mitchell will spend the rest of the Olympics, and beyond, in a walking boot and on crutches. He'll be at the stadium to watch Friday's final.

The United States is no shoo-in to win a medal this time, because LaShawn Merritt and Jeremy Wariner ? Olympic gold medalists in 2004 and 2008 ? are also both out with injuries. But the medals ceremony is Saturday, and if the U.S. finishes in the top three, Mitchell would get one, too, since he ran in the preliminaries.

Forgive him if he doesn't leap onto the podium, though.

"I pretty much figured it was broken, because every step I took, it got more painful," he said. "But I was out there already. I just wanted to finish and do what I was called in to do."
