GlaxoSmithKline to pay $3 billion for health fraud

(AP) ? GlaxoSmithKline LLC will pay $3 billion and plead guilty to promoting two popular drugs for unapproved uses and to failing to disclose important safety information on a third in the largest health care fraud settlement in U.S. history, the Justice Department said Monday.

Accompanying the criminal case was a civil settlement in which the government said the company's improper marketing included providing doctors with expensive resort vacations, European hunting trips, high-paid speaking tours and even tickets to a Madonna concert.

The $3 billion combined criminal-civil fine will be the largest penalty ever paid by a drug company, Deputy Attorney General James M. Cole said. The corporation also agreed to be monitored by government officials for five years to attempt to ensure the company's compliance, Cole said.

"Let me be clear, we will not tolerate health care fraud," Cole told a news conference at the Justice Department. He would not say whether any company executives were under investigation. The company's guilty plea and sentence have to be approved by a federal court in Massachusetts.

"For far too long, we have heard that the pharmaceutical industry views these settlements merely as the cost of doing business," Acting Assistant Attorney General Stuart F. Delery, head of Justice's civil division, said at the news conference. "That is why this administration is committed to using every available tool to defeat health care fraud."

Delery added, "Today's resolution seeks not only to punish wrongdoing and recover taxpayer dollars, but to ensure GSK's future compliance with the law." He noted that a similar recent settlement with Abbott Laboratories also included continuing compliance monitoring.

GlaxoSmithKline CEO Sir Andrew Witty expressed regret and said they have learned "from the mistakes that were made."

"Today brings to resolution difficult, long-standing matters for GSK," he said in a statement. "Whilst these originate in a different era for the company, they cannot and will not be ignored."

Crimes and civil violations like those in the GlaxoSmithKline case have been widespread in the pharmaceutical industry and have produced a series of case with hefty fines. One reason some have said the industry regards the fines as simply a cost of doing business is because aggressively promoting drugs to doctors for uses not officially approved ? including inducing other doctors to praise the drugs to colleagues at meetings ? has quickly turned numerous drugs from mediocre sellers into blockbusters, with more than $1 billion in annual sales.

In the last few years, the Justice Department has become much more aggressive in pursuing such fraud, often in whistleblower cases taken on by a handful of U.S. attorneys focused on such fraud. Among the most active are the U.S. attorneys in Boston, Philadelphia and San Francisco ? all in regions with numerous pharmaceutical and biotech company operations.

The prior record-setting case involved Pfizer Inc., the world's biggest drugmaker. Pfizer paid the government $2.3 billion in criminal and civil fines for improperly marketing 13 different drugs, including Viagra and cholesterol fighter Lipitor. Pfizer was accused of encouraging doctors to prescribe its drugs with free golf, massages, and junkets to posh resorts.

It is illegal to promote uses for a drug that have not been approved by the Food and Drug Administration ? a practice known as off-label marketing.

Prosecutors said GlaxoSmithKline illegally promoted the drug Paxil for treating depression in children from April 1998 to August 2003, even though the FDA never approved it for anyone under age 18. The corporation also promoted the drug Wellbutrin from January 1999 to December 2003 for weight loss, the treatment of sexual dysfunction, substance addictions and attention deficit hyperactivity disorder, although it was only approved for treatment of major depressive disorder.

Justice Department officials also said that between 2001 and 2007 GlaxoSmithKline failed to report to the FDA on safety data from certain post-marketing studies and from two studies of the cardiovascular safety of the diabetes drug Avandia. Since 2007, the FDA has added warnings to the Avandia label to alert doctors about potential increased risk of congestive heart failure and heart attack.

The drug corporation also agreed to resolve civil liability for promoting the drugs Paxil, Wellbutrin, Advair, Lamictal and Zofran for off-label, non-covered uses. In the civil settlement, the government said Advair was promoted as a first-line therapy for mild asthma though not approved for that and for chronic obstructive pulmonary disease with misleading claims. It said the anti-epileptic medicine Lamictal was promoted for off-label psychiatric uses, neuropathic pain and pain management. And it said certain forms of Zofran, approved only for post-operative nausea, were promoted to treatment of morning sickness in pregnant women.

The company also resolved accusations that it paid kickbacks to doctors to prescribe those drugs as well as the drugs Imitrex, Lotronex, Flovent and Valtrex.

"GSK's sales force bribed physicians to prescribe GSK products using every imaginable form of high priced entertainment, from Hawaiian vacations to paying doctors millions of dollars to go on speaking tours to a European pheasant hunt to tickets to Madonna concerts, and this is just to name a few," said Carmin M. Ortiz, U.S. attorney in Massachusetts.

Of the penalties, $1 billion covers criminal fines and forfeitures and $2 billion is for civil settlements with the federal government and the state governments of Massachusetts and Colorado.

In a statement, GlaxoSmithKline said it disagreed with some statements the Justice Department made in court papers. For example, the company said its settlement with the government does "not constitute an admission of any liability or wrongdoing in the selling and marketing of Lamictal, Zofran, Imitrex, Lotronex, Flovent, Valtrex, Avandia or Advair products. The government also made allegations about Paxil, Wellbutrin that the company did not admit."

"The civil settlement agreement contains many allegations that are either inaccurate or incomplete, that selectively tell only parts of the story, and that draw unwarranted conclusions from disputed facts," the company said.

Venezuela's Chavez, Capriles launch presidential race

SAN FRANCISCO DE YURUANI/MARACAY, Venezuela (Reuters) - President Hugo Chavez shook off his health problems to lead a massive rally on Sunday while opposition rival Henrique Capriles took to remote regions for the formal launch of Venezuela's presidential race.

Unable to repeat the frenetic campaigning of past elections due to his struggle with cancer, a fist-pumping Chavez nevertheless made a rare appearance at a rally in central Venezuela to underline he is fit enough for the October 7 vote.

"The Bolivarian hurricane has begun!" he roared to tens of thousands of supporters in the central town of Maracay, referring to his personal idol and Venezuela's independence hero, Simon Bolivar.

Capriles, a young ex-state governor seeking to end 13 years of socialist rule in the South American OPEC member, flew to two distant spots near the Brazilian and Colombian borders to highlight alleged government neglect of remote communities.

"Venezuela is a blessed country. We just lack a good government," he told indigenous inhabitants of the remote San Francisco de Yuruani hamlet, close to the majestic, flat-topped Roraima mountain in a barely populated region near Brazil.

With three months to the ballot, Chavez has a two-digit lead in most polls. Yet there is a large percentage of undecided voters and one pollster this week put the pair head-to-head.

After three operations to remove two malignant tumors during a year-long battle with cancer, the ever-upbeat Chavez, 57, has in recent weeks declared himself in full recovery and his energy levels appear to be surging just in time for the campaign.

"I want to thank Christ the Redeemer for allowing me to get through this difficult year," he said, after riding on the top of a truck for several hours through streets lined with ecstatic supporters against a backdrop of lush hills.

Most analysts agree the presidential vote is shaping into the closest since Chavez took power in 1999, turning himself into one of the world's most controversial leaders with his anti-American rhetoric and radical nationalization policies.

CAPRILES CROSSES COUNTRY

Former Miranda state governor Capriles - a center-left politician who admires Brazil's mix of free-market economics with strong welfare policies - is considered the opposition's best hope after being outwitted for years by the wily Chavez.

His dash from the capital Caracas to the remote southeast, then across to La Guajira village on the western border near the Caribbean, was part of an opposition strategy to highlight the 39-year-old's energy and youth in contrast with Chavez.

"My commitment is to reach the most forgotten people," he said. "Over there nearby is Brazil. Its government understood how to work. Brazil has taken off. Now it's Venezuela's turn."

Though Venezuela's opposition is more united than ever against Chavez, Capriles still faces a formidable task to overcome the president's unique rapport with the poor and vast spending power thanks to vast oil revenues.

Wearing his trademark red military beret, Chavez blew kisses, laughed and waved as he rode through the crowds.

"I am no longer Chavez, Chavez is a people. Millions of us are Chavez," he said in the inimitable rhetoric that has served him well over the years. "Whatever they do to me, whatever happens to me, a mere human, they cannot get rid of Chavez."

He looked notably bloated and overweight from the effects of his cancer treatment and heavy medication.

Unusually, state media, where Capriles is normally only mentioned in insults, covered some of his activities on Sunday.

At one point, a split screen showed the rival rallies under the captions "Candidate of the Fatherland" for Chavez and "Candidate of the Right" for Capriles.

Chavez's ministers lined up to call Capriles a "loser" and puppet of capitalism who would dismantle the popular missions Chavez has set up to provide free education, health services and subsidized food in poor areas.

The government says it has put $400 billion into social investments during Chavez's rule, reducing poverty by half to about 25-27 percent of the population of 29 million.

The opposition recognizes some welfare improvements, but say Chavez should have done far more due to an unprecedented bonanza of oil revenues in the last decade. They accuse him of running Venezuela in a dictatorial style, on the advice of Cuba's Fidel Castro, and allowing corruption to flourish.

"People here were Chavista, but we've been waiting 13 years for them to fulfill promises and now we're tired," said Nelson Franco, 40, in San Francisco de Yuruani.

As well as Capriles' events, the opposition also organized scores of caravans around the nation on Sunday. Government supporters held parties and vigils across Venezuela overnight.

"Chavez's whole heart is open to the people," said Girolamo Ambla, 43, dressed in the red colors of Chavez's Socialist Party and clutching a doll of the president.

Fake Craigslist ad for nude photos was 'prank'

7 hrs.

lt was meant as a "prank,"?but it wound up terrifying the victim: A male "friend" placed a Craigslist ad in a woman's name, along with graphic photos of her, inviting men to respond in kind and?send porn photos of themselves to the woman.

The woman, a resident of Chesterfield Township, Michigan, received more than 80 text messages within the first hour the ad was placed online, she told police.

"The person who posted it thought it would be funny, and didn't think it would get that many responses," Detective Sergeant Deron Myers of the Chesterfield Police told msnbc.com.

After the victim contacted police, they got a search warrant for Craigslist?to find out the name of the person who put the ad online. When the victim learned it was a friend of hers, she declined to press charges, Myers said. And the "friend" was appropriately remorseful, he said.

"It got way more attention than he thought" it would, Myers said. In the end,?"All parties just kind of shrugged it off as a tasteless joke."

Not all such incidents work out that way. Last year, Tracy Wilder, of Florida,?started getting knocks on her door, emails and text messages after the wife of Wilder's ex-husband placed a steamy?Craigslist ad in Wilder's name, giving out her phone number and inviting men to come to Wilder's home, with children living there.

The experience was "absolutely appalling,"?Wilder told TODAY's Ann Curry, last summer. (That video interview is below.)
