Switzerland shuts the door on EU migrants: A new 'us vs. them' in Europe?

News that Switzerland is capping residence permits for Western Europeans reached the Monitor's Europe bureau chief as she was having her own intolerable immigration experience.

The anti-immigration class across Europe has found many new adherents as of late, especially in the most economically devastated countries, like Greece and Italy. But now these Europeans might themselves become the unwelcome migrants, at least in Switzerland.

As I happened to be standing in the most intolerable immigration line that I've ever faced ? more on that later ? I read on my Twitter account that the Swiss government on Wednesday announced a new policy to cap residence permits for all of Western Europe. Switzerland, which is not part of the EU but joined the Schengen bloc that allows freedom of movement of people across European borders, says that it is being overwhelmed by arrivals from across the continent, to the tune of 80,000 people each year.

So it is invoking a ?safeguard clause? it negotiated during the 1999 Schengen treaty talk, which it already implemented for eight Central and Eastern European states. Now, as of May 1, residence permits for the citizens of 17 older EU states, from Germany to Spain, will be capped at 53,700 for a year.

According to the EU Observer, the Swiss said that the million-plus EU residents who live in the country have "had a positive impact ? in particular in terms of consumer spending and on the construction industry," but that restrictions are ?needed to make immigration more acceptable to society.?

The move drew immediate criticism from Brussels. ''The measures disregard the great benefits that the free movement of persons brings to the citizens of both Switzerland and the EU,? Catherine Ashton, EU foreign policy chief, said in a statement.

Is this a new manifestation of intolerance in Europe? The levels of resentment continent-wide against the migrants from Africa and the Middle East are already clearly documented, but in the midst of crisis, is Europe even excluding Europe? And what does that mean for identity and equality moving forward?

The possibility of a new, intra-European divide struck a chord for me, as I experienced my own "us vs. them" moment in France today.

Well, more than a moment. Eight hours, in fact.

That's how long I waited in a Paris prefecture along with Moroccans, Romanians, Malians, Senegalese, Tunisians, and Peruvians ? most of us, like me, there only to get information about what we needed to have with us, only to return and stand in line again.

I got to know my fellow immigrants well as we stood outside. Some around me had been in this line before, but were told they were missing a translation, a photocopy, or any of myriad document requirements that are not posted in their totality anywhere on the Internet ? or even on the wall of the prefecture where we line up ? but rather seem to be, at least from my informal surveys today, requested at the whim of whichever officer is behind the desk. One woman was told to bring back her CV.

Some of my linemates felt the French immigration officials were being deliberately obstructionist.

?They don?t want us to get the carte de sejour,? said the Malian, referring to the permission that allows foreigners to reside in France (and, with it, the right to tap into the country?s amazing social security system).

?They do everything they can to hold us back,? said the Romanian, who was on her third trip here ? and the third day lost on her job as a cleaning woman. Today, she was told that the pay stub she brought didn?t have the minimum number of hours on it, so she needed to bring in another stub. Another lost day of productivity for this poor woman.

Regardless of the motivations, one can see the "us vs. them" motif very clearly at the prefecture. On the one side, masses desperate to get in, and feeling unwelcome all the while. And on the other side of the glass wall, a society wanting to protect a social system that is replicated in few other places in the world.

By the end of the day in the unforgiving sun, some people were clearly losing their cool, me among them. (I, an American, was more indignant about the inefficiency than most, which makes me wonder if that?s a nationality trait, but that's a subject for another time.)

?But this can?t be!? I kept saying. ?How can people waste an entire day in a line ? and for nothing! Just to come back and stand in the line again??

?Welcome to France,? said the Malian, smiling.

Hansen has 'no plans to give up' fight for Kings

The recommendation has been made, the vote is set and the Sacramento Kings seem all but assured of staying in California's capital city.

Or are they?

In yet another twist to this unprecedented fight between two West Coast cities, investor Chris Hansen has vowed to "move forward with the transaction" he has with the Maloof family to buy the Kings and move the team to Seattle despite a unanimous recommendation from the NBA's relocation committee for owners to reject the bid.

Hansen said he plans to lobby the NBA Board of Governors, which consists of all 30 owners, again anyway the week of May 13. The board is expected to vote on the issue and follow the committee's recommendation ? which NBA Commissioner David Stern also is supporting ? during that meeting.

"When we started this process everyone thought it was impossible," Hansen wrote to Seattle fans on his website late Monday night, hours after the seven-person committee handed down its recommendation. "While this represents yet another obstacle to achieving our goal, I just wanted to reassure all of you that we have numerous options at our disposal and have absolutely no plans to give up. Impossible is nothing but a state of mind."

Sacramento Mayor Kevin Johnson remembers hearing about impossible, too.

In 2011, the Maloofs made plans to move the Kings to Anaheim, Calif. At one point, Johnson seemed so certain the team was gone he called the process a "slow death" and compared the city's efforts to keep the Kings to a "Hail Mary."

Instead, Johnson surprisingly convinced the NBA to give the city one last chance to help finance an arena. He delivered on his promise of a new arena plan ? given Stern's seal of approval ? before the end of last season. But in a stunning move, the Maloofs backed out of the tentative deal for a downtown arena, saying it didn't make financial sense.

The city of Sacramento and the owners broke off talks, reigniting fears the franchise could relocate. Cities such as Virginia Beach, Las Vegas and Kansas City surfaced as potential new homes.

In January, the Maloofs caught Sacramento ? and to a certain extent, the NBA ? by surprise when they announced the deal with Hansen's group, which includes Microsoft CEO Steve Ballmer and members of the Nordstrom department store family.

Led by Johnson, Sacramento fought back to make the sale and relocation of the Kings tough for the league to recommend. He pushed a non-binding financing plan for a $447 million downtown arena through the Sacramento City Council ? complete with a $258 million public subsidy ? and lined up an ownership group to try to compete with the powerful Seattle contingent.

At a packed pep rally at a downtown restaurant late Monday afternoon, Kings fans serenaded Johnson with chants of "Sac-ra-mento!" He called the committee's recommendation a "big day for the city of Sacramento" but cautioned fans not to declare victory just yet.

"We do not want to dance in the end zone. We do not want to celebrate prematurely," Johnson said.

TIBCO software chairman Vivek Ranadive, the head of the Sacramento investor group Johnson assembled to mount a competing bid to keep the Kings, also expressed excitement.

"I'm speechless. Thanks to all of the amazing people who supported this great effort," tweeted Ranadive, a minority owner of the Golden State Warriors who could become the first Indian-born majority owner of an NBA team. He would have to sell his share in the Warriors if his group's bid for the Kings is successful.

"We did it, baby," said California Senate President Pro Tem Darrell Steinberg. The Sacramento Democrat joined Johnson and Republican state Senator Ted Gaines at the rally in a show of bipartisan support.

Barbara "Sign Lady" Rust, as she has become known by Kings fans, waived a sign as Johnson spoke that read: "Love found a way, now here we stay!"

"You should have seen me a few hours ago," she said. "I totally lost it. First I jumped like a crazy woman for a minute. Then I cried."

Who will own the Kings next season is still unclear.

The Maloof family reached the agreement in January to sell a 65 percent controlling interest in the team to Hansen's group at a total franchise valuation of $525 million, topping the NBA-record $450 million that Joe Lacob and Peter Guber bought the Warriors for in 2010. Then Hansen increased his offer to $550 million, which implies buying the 65 percent stake for about $357 million.

Hansen hoped to move the team to Seattle and rebrand them the SuperSonics, who were relocated to Oklahoma City and renamed the Thunder in 2008. Those plans have suddenly seemed to crumble.

But Hansen insisted again that his group has a more solid arena plan, offered more money and "placed all of the funds to close the transaction into escrow." At the bottom of the post on his website, Hansen attributed a quote to boxing great Muhammad Ali that ended with the famous line: "Impossible is nothing."

The NBA Board of Governors is still expected to follow the recommendation by the seven-owner relocation committee, coincidentally headed by Thunder owner Clay Bennett, already a reviled figure in Seattle. The other owners on the committee are Miami's Micky Arison, Washington's Ted Leonsis, Utah's Greg Miller, Indiana's Herbert Simon, Minnesota's Glen Taylor and San Antonio's Peter Holt ? who's also the chairman of the board.

Even still, the Maloofs are not bound to sell the team to the Sacramento group ? and the threat of lawsuits always looms. Johnson said he was unsure what the next step is in the process or whether the NBA would ? or could ? take a role in streamlining the team's sale.

In a letter sent to the relocation and finance committees during its April 17 meeting, the Maloofs said they preferred to sell to the Seattle group and expressed discontent with Sacramento's latest bid, saying it falls "significantly short." Stern has said the offers are in "the same ballpark."

The commissioner also said the relocation committee felt leaving Sacramento just didn't make sense. He also reiterated his long-held stance that expansion is unlikely at this time.

"As strong as the Seattle bid was, and it was very strong, there's some benefit that should be given to a city that has supported us for so long and has stepped up to contribute to build a new building as well," Stern said on NBA-TV.

A Spokesman for the Maloof family declined to comment on the committee's recommendation. Seattle Mayor Mike McGinn pledged that his city will continue to fight for an NBA team.

"I'm proud of how Sonics fans have rallied together to help Seattle get a team," McGinn said in a statement. "We're going to stay focused on our job: making sure Seattle remains in a position to get a team when the opportunity presents itself."

The potential Sacramento ownership group also includes 24 Hour Fitness founder Mark Mastrov, former Facebook senior executive Chris Kelly and the Jacobs family that owns communications giant Qualcomm. Johnson has touted the group as a "California team" with members from all over the country's most populated state.

Johnson, a former NBA All-Star point guard known best by his initials "KJ," also commended Seattle for its efforts and wrote that the Pacific Northwest city "no doubt deserves a team in the future."

"Just not ours," he said.

"I feel good for KJ because he's worked so hard," said interim Brooklyn Nets coach P.J. Carlesimo, who worked with Johnson at NBC and coached the Sonics in their last season. "If it goes down that way, there's no question who deserves the credit because, I mean, they could've rolled over a long time ago. Kevin just really made this happen, which is great."

Seattle is now back to wondering when, and if, the NBA will ever return.

Hansen's purchase agreement with the Maloofs seemed the perfect solution for the heartache that has lingered in the Puget Sound region since the Sonics ? and their 41 years of history ? were moved to Oklahoma City. Hansen spent nearly two years working to get an arena plan approved by the city and county governments and spent more than $65 million buying land in Seattle's SoDo neighborhood where the arena would be built.

In the last few months, fan interest and support seemed to be at its highest since before Bennett purchased the team from Howard Schultz in 2006. Now those same fans are stuck waiting to see what the next move by Hansen and Ballmer will be, including mounting an effort for expansion or buying another team.

Hansen has a five-year memorandum of understanding with the city and county on the arena plan. Whether momentum for the NBA in Seattle will remain also is unclear.

NEW YORK (AP) ? Tebow Time is over in New York ? before it ever got started.

Tim Tebow was waived by the Jets on Monday, the end of an unsuccessful one-season experiment in New York.

Coach Rex Ryan said in a statement by the team in announcing the move that had been expected for months: "Unfortunately, things did not work out the way we all had hoped."

The Heisman Trophy winner attempted just eight passes after his ballyhooed arrival in a surprising trade from the Denver Broncos in March 2012. He threw for 39 yards and rushed 32 times for 102 yards ? and stunningly had no touchdowns as a member of the Jets.

Meanwhile, starter Mark Sanchez struggled amid constant questions about Tebow's playing time, and still Tebow remained mostly on the sideline. The Jets and new general manager John Idzik drafted former West Virginia star Geno Smith in the second round of the NFL draft Friday, giving New York six quarterbacks on its roster ? and creating uncertainty about Sanchez's future as well.

Tebow arrived at the team's facility in Florham Park, N.J., on Monday morning and was told he had been cut.

"Tim is an extremely hard worker, evident by the shape he came back in this offseason," Ryan said. "We wish him the best moving forward."

Tebow led the Broncos to the playoffs in 2011, but became expendable when Denver signed Peyton Manning as a free agent. The popular backup quarterback was acquired by the Jets for a fourth-round draft pick and $1.5 million in salary. He was introduced at the Jets' facility to plenty of fanfare at a lavish news conference, with Tebow repeatedly saying he was "excited" to be in New York.

It turned out to be one of the few high points in Tebow's stay with the Jets. Along with his shirtless jog from the practice field in the rain during training camp, of course.

Owner Woody Johnson jokingly said last season that "you can never have enough Tebow." Well, the Jets apparently had their fill after just one year.

From the day the Jets made the move to bring Tebow in to compete with Sanchez, many fans and media predicted it was only a matter of time before the former Florida star stepped in as the starting quarterback. There were billboards outside the Lincoln Tunnel in New Jersey welcoming Tebow, and sandwiches named after him at Manhattan delis.

Meanwhile, the Jets insisted having both Tebow and Sanchez would not be a distraction. The plan was that the team would benefit from having both players' different skill sets: Sanchez as the traditional quarterback, and Tebow running the wildcat-style offense.

While everyone from Johnson to Ryan to former general manager Mike Tannenbaum to former offensive coordinator Tony Sparano said they were all "on board" with Tebow, it became evident early that he had no clear role.

And Tebow simply didn't impress enough in practice to earn more playing time.

Ryan refused to start Tebow in place of a struggling Sanchez late in the season, choosing instead to go with third-stringer Greg McElroy ahead of him for one game ? despite Tebow's multitude of fans taking to Twitter and begging the team to give their favorite player a chance. The since-fired Sparano never was able to figure out a way to consistently use Tebow, who spent most of his time on the sideline during games.

He was solid in his role on special teams as the personal punt protector, but the Jets stopped using him even there after he broke two ribs in a game at Seattle in November. Tebow's overall role diminished greatly after the injury, even after he healed. He tried to hide his frustration, but acknowledged late in the season that things didn't turn out quite how he expected in New York.

"I think it's fair to say," Tebow said, "that I'm a little disappointed."

The Jets appear to be sticking with Sanchez despite his struggles and the arrival of Smith as the future quarterback because he is guaranteed $8.25 million this season. But Idzik made it clear that the team would bring in competition for Sanchez. Tebow, however, is not going to be among the team's options. And, he's free to explore other opportunities ? even if there don't seem to be many at this point.

It appeared Jacksonville, the other team to pursue Tebow last offseason, would be an obvious landing spot. But new general manager David Caldwell nixed the idea of a happy homecoming when he declared at his introductory news conference that he couldn't "imagine a scenario in which he'll be a Jacksonville Jaguar."

Many believe Tebow's best chance to stick in the NFL would be to switch positions, but he insists he is a quarterback and just wants an opportunity. Just as the Broncos gave him two seasons ago when he took over for Kyle Orton and led Denver to several comeback victories and into the playoffs.

Tebow was the talk of the country back then, as it seemed everyone ? including actor Robert Downey Jr. at the Oscars ? was dropping to a knee to do their version of "Tebowing," mimicking the quarterback's prayerful pose.

It was something that was absent all season in his stint with the Jets.

Chicago could be a possibility since new coach Marc Trestman worked with Tebow before the NFL draft in 2010 and in the Senior Bowl and liked what he saw. He'd be a backup there behind Jay Cutler, though. Tampa Bay, San Diego and New England might also be options.

Tebow could also head to Canada and play in the CFL, taking the route several others before him have, such as Doug Flutie, Warren Moon and Jeff Garcia. The Montreal Alouettes own his exclusive negotiating rights, but whether Tebow would even be open to a move north of the U.S. border is uncertain.

Brett Bouchy, the owner of the Orlando Predators of the Arena League, recently told the Orlando Sentinel that his team would "love to have him," and added that "we have a contract waiting for him to sign."

Either way, it's quite a fall from grace for Tebow, who was a two-time national champion with the University of Florida, and whose No. 15 Broncos jersey ranked second in national sales to Green Bay's Aaron Rodgers in 2011. He remained a model citizen throughout his frustrating year in New York and answered the constant barrage of questions about his role and mindset all season.

Recently retired Jets special teams coordinator Mike Westhoff labeled the way the team used Tebow an "absolute mess." Former Jets teammate Mike DeVito, now with Kansas City, said after the season that he would've liked to have seen Tebow get a chance.

Whether Tebow gets another one elsewhere ? and if it's as a quarterback ? this season remains to be seen.

Lawmaker: FBI checking training angle in bombing

WASHINGTON (AP) ? The chairman of the House Homeland Security Committee said Sunday that the FBI is investigating in the United States and overseas to determine whether the suspects in the Boston Marathon bombing received training that helped them carry out the attack.

Dzhokhar Tsarnaev, 19, is charged with joining with his older brother, Tamerlan, who's now dead, in setting off the shrapnel-packed pressure-cooker bombs. The bombs were triggered by a remote detonator of the kind used in remote-control toys, U.S. officials have said.

U.S. officials investigating the bombings have told The Associated Press that so far there is no evidence to date of a wider plot, including training, direction or funding for the attacks.

A criminal complaint outlining federal charges against Dzhokhar Tsarnaev described him as holding a cellphone in his hand minutes before the first explosion.

The brothers are ethnic Chechens from Russia who came to the United States about a decade ago with their parents.

"I think given the level of sophistication of this device, the fact that the pressure cooker is a signature device that goes back to Pakistan, Afghanistan, leads me to believe ? and the way they handled these devices and the tradecraft ? ... that there was a trainer and the question is where is that trainer or trainers," said Rep. Michael McCaul, R-Texas, on "Fox News Sunday."

"Are they overseas in the Chechen region or are they in the United States?" McCaul said. "In my conversations with the FBI, that's the big question. They've casted a wide net both overseas and in the United States to find out where this person is. But I think the experts all agree that there is someone who did train these two individuals."

Rep. Adam Schiff, D-Calif., a member of the House Intelligence Committee, said he thought it's "probably true" that the attack was not linked to a major group. But, he told CNN's "State of the Union," that there "may have been radicalizing influences" in the U.S. or abroad. "It does look like a lot of radicalization was self-radicalization online, but we don't know the full answers yet."

On ABC's "This Week," moderator George Stephanopoulos raised the question to the chairman of the House Intelligence Committee about FBI suspicions that the brothers had help in getting the bombs together.

"Absolutely, and not only that, but in the self-radicalization process, you still need outside affirmation," responded Rep. Mike Rogers, R-Mich.

"We still have persons of interest that we're working to find and identify and have conversations with," he added.

At this point in the investigation, however, Sen. Claire McCaskill said there was no evidence that the brothers "were part of a larger organization, that they were, in fact, part of some kind of terror cell or any kind of direction."

The Missouri Democrat, who's on the Senate Homeland Security and Governmental Affairs Committee, told CBS' "Face the Nation" that "it appears, at this point, based on the evidence, that it's the two of them."

Homemade bombs built from pressure cookers have been a frequent weapon of militants in Afghanistan, India and Pakistan. Al-Qaida's branch in Yemen once published an online manual on how to make one.

Tamerlan Tsarnaev was an ardent reader of jihadist websites and extremist propaganda, officials have said. He frequently looked at extremist sites, including Inspire magazine, an English-language online publication produced by al-Qaida's Yemen affiliate.

In recent years, two would-be U.S. attackers reported receiving bomb-making training from foreign groups but failed to set off the explosives.

A Nigerian man was given a mandatory life sentence for trying to blow up a packed jetliner on Christmas Day 2009 with a bomb sewn into his underwear. Umar Farouk Abdulmutallab had tried to set off the bomb minutes before the Amsterdam-to-Detroit flight landed.

The device didn't work as planned, but it still produced smoke, flame and panic. He told authorities that he trained in Yemen under the eye of Anwar al-Awlaki, a radical American-born cleric and one of the best-known al-Qaida figures.

In 2010, a Pakistani immigrant who tried to detonate a car bomb in New York's Times Square also received a life sentence. Faisal Shazad said the Pakistan Taliban provided him with more than $15,000 and five days of explosives training.

The bomb was made of fireworks fertilizer, propane tanks and gasoline canisters. Explosives experts said the fertilizer wasn't the right grade and the fireworks weren't powerful enough to set off the intended chain reaction.

Luis Suarez has accepted the FA?s 10-match ban after deciding not to appeal the punishment for biting Chelsea defender Branislav Ivanovic.

Liverpool received the independent panel?s written reasoning for the length of Suarez? suspension and had until noontime Friday to contest ruling. In deciding against doing so, the 26 year old?will now miss the remaining four games of the Premier League season and the first six domestic games of next term, assuming he remains at Anfield.

The FA confirmed Suarez? decision to accept the ban in a statement: ?Liverpool forward Luis Suarez has not appealed the suspension issued to him by an independent regulatory commission this week.

?A three-person independent regulatory commission upheld the FA?s claim that a suspension of three matches was clearly insufficient and the player will now serve a further seven first-team matches in addition to the standard three.

?The suspension begins with immediate effect and applies to Liverpool FC?s next 10 domestic first-team fixtures.

?The FA intends to publicise the independent regulatory commission?s written reasons in due course.?

MTV Movie Awards Winners (FULL LIST)

The MTV Movie Awards were held last night! Rebel Wilson killed as the host of the live show, which is usually not held until June. You can see a full list of winners below along with a couple of fabulous videos from the night. They are called the anti awards show if you will. The MTV Movie Awards are all about fun, this is not the Oscars for sure and it is one of my favorite awards show. This year instead of having the fun filled ceremony in the summer,? it was moved up a coupe of months in order to help promote some of summers highly anticipated blockbusters like Iron Man 3 and The Hunger Games: Catching Fire. Second Higgs boson? Physicists debate new particle

DENVER ? The discovery of the Higgs boson is real. But physicists are cagey about whether the new particle they've found will fit their predictions or not.

So far, the data suggest that the Higgs, the particle thought to explain how other particles get their mass, is not presenting any surprises, physicists said here Saturday at the April meeting of the American Physical Society. But that doesn't mean that it won't in the future ? or that there might not be other Higgs bosons lurking out there.

"There's a large number of theoretical models that predict, actually, that this Higgs field is more complicated," said Markus Klute, a physicist at the Massachusetts Institute of Technology. Some of these theories predict five or more Higgs bosons of different masses, Klute told reporters. [The Top 5 Implications of Finding the Higgs]

The mystery of the Higgs
Physicists confirmed in March that a new particle discovered at the world's largest atom smasher, the Large Hadron Collider (LHC), is, in fact, the Higgs boson. This particle, which weighs about 126 times the mass of a proton, appears to fit the Standard Model of physics, the dominant theory of particle physics. In this model, the Higgs boson is related to the Higgs field, an energy field that pervades space and is thought to imbue many particles with mass. The thinking goes that just as swimmers would get wet moving through a pool, as particles move through the Higgs field they would gain mass.

This "vanilla" Higgs has been something of a disappointment to physicists hoping to find something that would upend their theories.

"Sometime in November, I was depressed a little bit by the fact that everything lines up so well," Klute said. "They call this 'post-discovery depression.'"

But researchers say there's more to learn about the Higgs, including whether it's the only one. It's possible that when the Large Hadron Collider revs up again in 2015 with more power, scientists may be able to detect heavier variations of the Higgs boson. Or variations may be hiding in the data collected already.

"As far as 'Is the Higgs standard or not standard,' we're not in the game yet," said Michael Peskin, a physicists at SLAC National Accelerator Laboratory at Stanford University. "We will be in the game later this decade, but right now it's just an open question."

A secondary spike in Higgs data presented in December 2012 led to speculation that physicists had perhaps found a second Higgs boson of a different mass. However, that spike showed up in only one LHC experiment. Other lines of evidence produced at the collider have failed to show similar anomalies.

Questions ahead
The 17-mile-long (27 kilometers) underground loop that is the Large Hadron Collider is currently shut down until 2015 as engineers tinker to bring the atom smasher to its fullest potential. Upping the energy levels of the LHC will allow for more collisions, and up to five times the precision in measurements as seen today, Klute said.

One popular theory physicists hope to put to an experimental test is "supersymmetry," which holds that every subatomic particle has a secret twin that has yet to be observed. "Superpartners" could help explain dark matter, a mysterious substance that may makes up a quarter of the entire universe.

So far, physicists can only account for 4 percent of what the universe is made of, said Thomas Koffas, a physicist at Carleton University in Canada.

"The remaining 96 percent," Koffas said, "we have no idea."

The Current Microtrend in the S&P 500 - Political Calculations ...

Today, we're following up our exploration of the fractal nature of the S&P 500 with an updated version of what we'll describe as the current micro-rally in the market, to which we've added some key points of reference:

On 5 April 2013, the trailing year dividends per share we're projecting based on the available dividend futures for 2013-Q2 was $32.20, with the S&P 500 closing at $1,553.28. At present, the projected trailing year dividends per share for the S&P 500 is increasing at an average rate of $0.0177 per trading day, or $0.088 per 5-day trading week.

The "sell signal" provided by our power-law, regression and statistical analysis-based method would be found by taking a given trading day's projected value for trailing year dividends per share and plugging it into the power-law formula we've indicated on the chart, then subtracting that result by three times the standard deviation for the current trend that we've also indicated on the chart. A slightly more conservative approach would be to use the 20-day moving average of the S&P 500 instead of the closing daily index value as the price that would trigger an investor's decision to sell.

We do realize that this looks a bit like technical analysis, which in our view, is really a very weak form of statistical analysis. And since we mentioned the fractal properties that stock prices have, we can see where some might think that we're keying into Elliot wave theory.

Fast-growing dinosaurs kicked inside eggs, say scientists

The bones, all from not-yet-hatched embryonic dinosaurs, are among the oldest?dinosaur-embryo fossils?ever found. What's more, the embryo fossils came from separate nests and the dino embryos were at different stages of development when they died ? two discoveries that will enable researchers to study how dinosaurs developed before hatching.

"It tells us quite a bit about early embryonic stages and changes that occur in the embryonic life of these animals ? something we haven't really seen before," said study researcher Robert Reisz, a paleontologist at the University of Toronto.

In addition to discovering evidence of in-egg kicking, the researchers found that the embryos, which probably belonged to the long-necked?Lufengosaurus, grew faster than the embryos of any birds or mammals alive today. [See Images of the Tiny Dino Embryos]

Tiny-bone find

Timothy Huang, a chemist at National Chung Hsing University in Taiwan and an amateur archaeologist, discovered the embryonic bones about three years ago in Yunnan Province, China. The bone bed has an area of about 3 square feet (1 square meter) and a thickness of about 4 to 8 inches (10 to 20 centimeters). In this small patch, the researchers eventually uncovered more than 200 itsy-bitsy bones.

A geological analysis of the spot revealed that slow flooding probably smothered the eggs, which seem to have been laid in a colonial nesting site. After the flood, the embryos and eggs rotted and fell apart, leaving a mound of disarticulated bones. The bones date to the Lower Jurassic period, or between 199.6 million and 175.6 million years ago. That makes them just as ancient as the?oldest known embryos ever found, which were discovered at a nesting site of long-necked?Massospondylus?dinosaurs in South Africa.?

It was a boon for science that the dino embryos had fallen apart, instead of fossilizing inside their eggs, Reisz told LiveScience.

"People are extremely possessive and fond of their embryos?inside their eggs?? imagine us asking them to take pieces out and do the sections on them and cut them, and essentially do damage to them," he said. "These bones are completely disarticulated, and we have a lot of them ? so it's not unreasonable to be able to take a few and cut them, and see what their internal anatomy is like."

Ice cloud heralds fall at Titan's south pole

An ice cloud taking shape over Titan's south pole is the latest sign that the change of seasons is setting off a cascade of radical changes in the atmosphere of Saturn's largest moon. Made from an unknown ice, this type of cloud has long hung over Titan's north pole, where it is now fading, according to observations made by the Composite Infrared Spectrometer (CIRS) on NASA's Cassini spacecraft.

"We associate this particular kind of ice cloud with winter weather on Titan, and this is the first time we have detected it anywhere but the north pole," said the study's lead author, Donald E. Jennings, a CIRS Co-Investigator at NASA's Goddard Space Flight Center in Greenbelt, Md.

The southern ice cloud, which shows up in the far infrared part of the light spectrum, is evidence that an important pattern of global air circulation on Titan has reversed direction. When Cassini first observed the circulation pattern, warm air from the southern hemisphere was rising high in the atmosphere and got transported to the cold north pole. There, the air cooled and sank down to lower layers of the atmosphere, where it formed ice clouds. A similar pattern, called a Hadley cell, carries warm, moist air from Earth's tropics to the cooler middle latitudes.

Based on modeling, scientists had long predicted a reversal of this circulation once Titan's north pole began to warm and its south pole began to cool. The official transition from winter to spring at Titan's north pole occurred in August 2009. But because each of the moon's seasons lasts about 7-1/2 Earth years, researchers still didn't know exactly when this reversal would happen or how long it would take.

The first signs of the reversal came in data acquired in early 2012, which was shortly after the start of southern fall on Titan, when Cassini images and visual and infrared mapping spectrometer data revealed the presence of a high-altitude "haze hood" and a swirling polar vortex at the south pole. Both features have long been associated with the cold north pole. Later, Cassini scientists reported that infrared observations of Titan's winds and temperatures made by CIRS had provided definitive evidence of air sinking, rather than upwelling, at the south pole. By looking back through the data, the team narrowed down the change in circulation to within six months of the 2009 equinox.

Despite the new activity at the south pole, the southern ice cloud hadn't appeared yet. CIRS didn't detect it until about July 2012, a few months after the haze and vortex were spotted in the south, according to the study published in Astrophysical Journal Letters in December 2012.

"This lag makes sense, because first the new circulation pattern has to bring loads and loads of gases to the south pole. Then the air has to sink. The ices have to condense. And the pole has to be under enough shadow to protect the vapors that condense to form those ices," said Carrie Anderson, a CIRS team member and Cassini participating scientist at NASA Goddard.

At first blush, the southern ice cloud seems to be building rapidly. The northern ice cloud, on the other hand, was present when Cassini first arrived and has been slowly fading the entire time the spacecraft has been observing it.

So far, the identity of the ice in these clouds has eluded scientists, though they have ruled out simple chemicals, such as methane, ethane and hydrogen cyanide, that are typically associated with Titan. One possibility is that species X, as some team members call the ice, could be a mixture of organic compounds.

"What's happening at Titan's poles has some analogy to Earth and to our ozone holes," said the CIRS Principal Investigator, NASA Goddard's F. Michael Flasar. "And on Earth, the ices in the high polar clouds aren't just window dressing: They play a role in releasing the chlorine that destroys ozone. How this affects Titan chemistry is still unknown. So it's important to learn as much as we can about this phenomenon, wherever we find it."

U.S. says N. Korea test would be "big mistake"

SEOUL (Reuters) - U.S. Secretary of State John Kerry warned North Korea on Friday it would be a "huge mistake" to test launch a medium-range missile and said the United States would never accept the reclusive country as a nuclear power.

Addressing reporters after talks with South Korea's president and leaders of the 28,000-strong U.S. military contingent in the country, Kerry also said it was up to China, North Korea's sole major ally, to "put some teeth" into efforts to press Pyongyang to abandon its nuclear ambitions.

Kerry, like other U.S. officials, played down an assessment from the Pentagon's intelligence agency that the North already had a nuclear missile capacity.

The United States, he said, wanted to resume talks about North Korea's earlier pledges to halt its nuclear programme.

But he also stressed that Washington would defend its allies in the region if necessary and pointedly said that Kim Jong-un, the North Korean leader, "needs to understand, as I think he probably does, what the outcome of a conflict would be".

North Korea has repeatedly said it will not abandon nuclear weapons which it said on Friday were its "treasured" guarantor of security.

Kerry's visit coincided with preparations for Monday's anniversary of North Korean state founder Kim Il-Sung's birth date, a possible pretext for a show of strength, with speculation focusing on a possible new missile test launch.

Kerry, who flies to China on Saturday and to Japan on Sunday, said that if North Korea's 30-year-old leader went ahead with the launch, "he will be choosing, wilfully, to ignore the entire international community".

"I would say ahead of time that it is a huge mistake for him to choose to do that because it will further isolate his country and further isolate his people, who frankly are desperate for food, not missile launches."

SHRILL RHETORIC

The North has issued weeks of shrill threats of an impending war following the imposition of U.N. sanctions in response to its third nuclear test in February. Kerry said the threats were "simply unacceptable" by any standard.

"We are all united in the fact that North Korea will not be accepted as a nuclear power," he said.

Kerry later told U.S. executives in Seoul that China, as an advocate of denuclearisation, was in a position to press for a change in the North's policy.

"The reality is that if your policy is denuclearisation and it is theirs as it is ours, as it is everybody's except the North at this moment ... if that's your policy, you've got to put some teeth into it," he told the gathering.

But North Korea showed little inclination for further talks.

Rodong Sinmun, the mouthpiece of the ruling Workers' Party, said Pyongyang would never abandon its nuclear programme.

"The DPRK will hold tighter the treasured sword, nuclear weapons," it said, referring to the country by its official name, the Democratic People's Republic of Korea.

BIRTHDAY CELEBRATIONS

North Korean state television showed footage of newscasts from other countries depicting the trajectory a North Korean missile launch might take.

It also showed preparations for the Kim Il-Sung birthday festivities, including floral tributes, and a stadium of thousands of school children of the Korean Children's Union, each wearing a red scarf and saluting and marching in unison.

Speculation has mounted of an impending medium-range missile test launch in the North after reports in South Korea and the United States that as many as five medium-range missiles have been moved into position on the country's east coast.

Officials in both countries believe the North is preparing to test-launch a Musudan missile, whose range of 3,500 km (2,100 miles) or more would put Japan within striking distance and may threaten the island of Guam, which houses U.S. military bases.

The North has been angry about annual military drills between U.S. and South Korean forces, describing them as a "hostile" act. The United States dispatched B52 and B2 stealth bombers from their bases to take part.

Hours before Kerry's arrival, a U.S. lawmaker quoted a report by the U.S. Defence Intelligence Agency, one of the 17 bodies that make up the U.S. intelligence community, as saying it had "moderate confidence" that North Korea had developed a nuclear bomb that could be fitted on a ballistic missile.

But Kerry poured cold water on the report said it was "inaccurate to suggest that the DPRK has fully tested, developed capabilities" as set down in the document.

South Korea's Defence Ministry said it did not believe North Korea could mount a nuclear warhead on a missile.

A U.S. official had earlier suggested that Washington's greatest concern was the possibility of unexpected developments linked to Kim Jong-un's "youth and inexperience". Asked if war seemed imminent, he replied: "Not at all."

South Korean President Park Geun-hye, meeting officials from her ruling Saenuri Party before her talks with Kerry, struck a conciliatory note by suggesting Seoul should at least listen to what North Korea had to say.

"We have a lot of issues, including the Kaesong industrial zone," local media quoted her as saying. So should we not meet with them and ask: "Just what are you trying to do?'"

The president was referring to North Korea's closure this week of the jointly run Kaesong industrial park, with the loss of 53,000 jobs.

Kerry said the United States would not object to the South talking to the North. He also did not rule out the possibility of U.S. aid some day flowing to the North, but suggested this could only happen if Pyongyang undertook real denuclearisation.

Kerry sounded upbeat about resolving a dispute between the United States and South Korea over a civil nuclear cooperation agreement that expires next year, saying he thought a compromise could be found by Park's visit to Washington next month.

South Korea is believed to want the right to reprocess its spent nuclear fuel, which would allow it to deal with a mounting stockpile of nuclear waste.

However, this could also allow it to produce bomb-grade fissile material, a step Washington is loathe to see it take in part because of its nuclear standoffs with Iran and North Korea.

"We are ... very concerned at this time about not having any ingredients that could alter our approach ... to either of those," he said. But Kerry added that he was "confident that one option or another will be able to come to fruition (with South Korea) by the time that President Park comes to Washington." GE to buy oil pump maker Lufkin for nearly $3 billion

(Reuters) - General Electric Co is buying oilfield pump maker Lufkin Industries Inc for $2.98 billion, sharply increasing its presence in the fast-growing market to extract oil and natural gas from shale rock, the conglomerate said on Monday.

Lufkin's pumps, also known as artificial lift products, are commonly seen seesawing back and forth on top of energy wells to pull oil and natural gas to the surface.

The deal, which the parties expect to close by June, is GE's first major acquisition since the conglomerate sold its remaining stake in NBC Universal two months ago and will nearly double revenues of the company's Oil & Gas unit. CEO Jeff Immelt has spoken openly of GE's plans to focus more on growth in the energy-rich shale fields of North Dakota, Texas and elsewhere in the United States.

GE Oil & Gas will become the company's third-largest manufacturing unit by revenue behind the power and water and aviation units. It has been growing at a breakneck clip, posting a 16 percent jump in revenue from 2011 to 2012.

The unit posted 2012 revenue of $1.92 billion, and Lufkin had 2012 revenue of about $1.3 billion.

Immelt said last fall that GE would seek acquisitions in the $1 billion to $3 billion range. Natural gas development is "the place to play both in terms of the U.S. and the rest of the world," he told analysts at the time.

Lufkin, named for its hometown in Texas, was founded in 1902 to make railroad equipment. The company expanded into oil pumps in 1925 and stayed private until launching an initial public offering in 1990.

GE has spent about $11 billion in acquisitions since 2007 to boost its presence in the oil and gas business, which is its fastest-growing and accounts for about 10 percent of its revenue.

"There's certainly a big premium here for Lufkin, but I don't think they overpaid," said Oliver Pursche, president of Gary Goldberg Financial Services in Suffern, New York, which owns GE shares.

"I think you're going to see a significant increase in M&A activity by a lot of similar firms, because that's the only way they're going to grow" in the oil and natural gas industry, he said.

The Lufkin deal is a positive use for GE's $125.7 billion cash pile at a time of cheap interest rates, Pursche said.

GE's energy business also makes underground pumps that pull oil and gas to the surface, as well as wellheads, compressors and filters.

"This (Lufkin) deal is really going to round out our portfolio," Daniel Heintzelman, head of GE Oil & Gas, said in an interview. Heintzelman, who joined GE in 1979, is a member of the company's corporate executive council and previously worked with GE's aircraft engine business.

GE expects the oil pump market to grow at 12 percent to 13 percent per year for at least the next decade, said Heintzelman, citing statistics that at least 94 percent of oil wells will need pumps or lifts at least once in their lifetime.

Lufkin has "a great brand in the marketplace, and we hope to build on that," Heintzelman said.

GE has not decided whether it will keep the Lufkin brand name or retain the company's executives, but it is inclined to keep staff members, Heintzelman said.

"Talent in this industry, people in this industry, are crucial," he said.

Lufkin's fourth-quarter profit beat analysts' estimates on demand for its pumping equipment from companies operating in energy-rich shale fields such as North Dakota's Bakken and the Eagle Ford in Texas, despite a slowdown in overall drilling activity.

However, the company estimated that a slow recovery in the stalled U.S. onshore drilling would dent profits this quarter.

Lufkin primarily operates in North America, and GE plans to export the company's pumps and other technology to energy fields all over the world, Heintzelman said.

The offer is higher than Lufkin's intrinsic value of $70.98 per share as measured by Thomson Reuters StarMine.

The StarMine model is a measure of a stock's current value when considering analysts' growth estimates for five years, and then modeling the typical growth trajectory over a longer period of time.

The deal values Lufkin at $88.50 per share, a premium of more than 38 percent to the stock's Friday close. Lufkin shares rose 37.5 percent to $87.90 in afternoon trading, while GE were up 0.5 percent to $23.04.

Simmons & Co advised Lufkin, while Goldman Sachs and Deutsche Bank advised GE.

Luke Bryan pulls off huge upset at ACM Awards

Luke Bryan pulled off a shocking win on Sunday night when he beat out heavyweights Blake Shelton, Jason Aldean, Miranda Lambert and Taylor Swift to win the Academy of Country Music Award's biggest prize of the evening: entertainer of the year. The winner is chosen by fan votes.

The musician, who co-hosted the show with Shelton, was stunned after his name was announced, and appeared to cry as he slowly walked out from backstage to accept the award from Shania Twain, who was making her first appearance at the ACMs in 10 years. Even with his trophy in hand, Bryan stood in silent shock at the microphone for a long while.

"This is ... I don't know what to say, you guys," he finally started. "Thank you guys so much, fans, for doing this to me, thank you so much for making my life what it is. What I always wanted to be was just a country singer that got to ride on a tour bus and show up on a new stage and play music every night. ? I just started headlining! ? Every time I step on stage, it is a blessing to me to play for fans. ... This is the defining moment of my life!"

Bryan, 36, been on the scene since his debut album was released in 2007, but wasn't a headlining act until his single "Country Girl (Shake It for Me)" exploded after he started delivering booty-shaking performances of the catchy tune at awards shows in 2011.

The other big winner of the night was Shelton's wife, Miranda Lambert. She took home three of the four trophies she was nominated for: song and single record of the year for "Over You," and female vocalist for the fourth year in a row. Lambert shared the song of the year victory with her husband, who co-wrote the tune.

"Last time this happened, you didn't get a chance to talk, and you're not going to get a chance either this time," he joked as he and his wife accepted their trophies. "I'll?tell you all something: I?ve learned so much from this human being standing next to me ? she blows me away, but as far as standing here right now, I used to think I was a decent songwriter until I started hanging out with her."

Notable moments from the show included Garth Brooks and George Strait's performance together; Reba McIntire's announcement that the ACM was "renaming its most prestigious honor to the ACM Dick Clark Artist of the Decade Award"; and Stevie Wonder closing the show with "Signed, Sealed, Delivered."

Higher mercury levels in humans associated with increased risk for diabetes

Apr. 5, 2013 ? A new study found that higher levels of mercury exposure in young adults increased their risks for type 2 diabetes later in life by 65 percent. The study, led by Indiana University School of Public Health-Bloomington epidemiologist Ka He, is the first to establish the link between mercury and diabetes in humans.

The study paints a complicated nutritional picture because the main source of mercury in humans comes from the consumption of fish and shellfish, nearly all of which contain traces of mercury. Fish and shellfish also contain lean protein and other nutrients, such as magnesium and omega-3 polyunsaturated fatty acids, that make them important to a healthy diet.

In the study, published online early in the journal Diabetes Care, the people with the highest levels of mercury also appeared to have healthier lifestyles -- lower body mass indexes and smaller waist circumferences, more exercise -- than other study participants. They also ate more fish, which is a possible marker of healthy diet or higher social economic status. Risk factors for type 2 diabetes include being overweight.

The study, which involved 3,875 men and women, established the link between mercury levels and type 2 diabetes risk after controlling for lifestyle and other dietary factors such as magnesium and omega-3 polyunsaturated fatty acids, which could counter the effects of the mercury.

These findings, said He, point to the importance of selecting fish known to have low levels of mercury, such as shrimp, salmon and catfish, and avoiding fish with higher levels, such as swordfish and shark. FDA and EPA guidelines for fish consumption highlight this, particularly for women who are pregnant or of childbearing age and for young children.

"It is likely that the overall health impact of fish consumption may reflect the interactions of nutrients and contaminants in fish. Thus, studying any of these nutrients and contaminants such as mercury should consider confounding from other components in fish," He and the authors wrote in the study. "In the current study, the association between mercury exposure and diabetes incidence was substantially strengthened after controlling for intake of LCn-3PUFAs (omega-3) and magnesium."

The study participants were recruited from Birmingham, Ala., Oakland, Calif., Chicago and Minneapolis,and then followed for 18 years as part of the Coronary Artery Risk Development in Young Adults Study. He, chair of the Department of Epidemiology and Biostatistics in the IU School of Public Health-Bloomington, is principal investigator of the ancillary study, the CARDIA Trace Element Study, which is funded by the National Institutes of Health.
